Vitaspan Terms of Use

1. Agreement

These terms are an agreement between you and Julio Hartstein, the developer of Vitaspan ("we", "us"), about your use of the Vitaspan app. By agreeing in the app, or by using it, you accept these terms and the Privacy Policy. If you don't agree, don't use the app.

You get Vitaspan from Apple's App Store or TestFlight, so Apple's Licensed Application End User License Agreement (the "Apple EULA") also applies: it's your license to use the app, and it covers warranties and liability. These terms add to it; if they conflict, the Apple EULA applies.

2. Not medical advice

Vitaspan helps you keep your health information in one place and prepare for your appointments. It isn't a medical device and doesn't provide medical advice, diagnosis or treatment.

What its AI features produce, such as answers in Ask, summaries of your documents and suggested questions for your doctor, is generated automatically from the information you provide. It can be incomplete or wrong. Use it as something to discuss with your doctor, not as a decision: don't start, stop or change a medication, treatment, diet or exercise program because of it without talking to your doctor first, and never ignore or delay medical advice because of it.

If you think you may have a medical emergency, call 911 or your local emergency number right away.

3. Who can use Vitaspan

You must be 18 or older. You're responsible for what you enter in the app, for keeping your iPhone secure, and for keeping backups. If you set up Vitaspan for someone else, such as a family member, or import their records, you need their permission.

4. AI features and your Anthropic key

  • The AI features are optional and need an Anthropic API key, entered in Settings → Claude.
  • The key belongs to an Anthropic account. Its holder pays Anthropic for what the AI features use and agrees to Anthropic's terms and usage policies. We don't charge for the AI features today.
  • Set a monthly spending limit in Anthropic's console. We're not responsible for charges on an Anthropic account.
  • What the AI produces can be incomplete or wrong (section 2).

5. Your content

What you enter, import or add stays yours, on your iPhone, and we get no rights to it. When you use an AI feature, what it needs is sent to Anthropic, as the Privacy Policy explains.

6. Beta versions

Test versions shared through TestFlight are unfinished. They can have bugs, lose data or stop working, their features can change or be removed, and they expire under Apple's TestFlight rules. Don't rely on a beta as the only copy of important records, and tell us what goes wrong.

7. Acceptable use

Don't misuse the app: don't use it to break the law or anyone's rights, don't interfere with how it works, and don't copy, modify or reverse engineer it except where the law allows.

8. Other services

Vitaspan works with services from other companies, such as Apple Health, Anthropic, Open Food Facts, and Mail, Messages or WhatsApp. Their own terms apply to them, and we're not responsible for them.

9. Disclaimers and limits of liability

As far as the law allows, Vitaspan is provided "as is" and "as available", without warranties of any kind, as the Apple EULA describes. As far as the law allows, we're not liable for indirect, incidental, special or consequential damages, or for lost data, arising from your use of the app, and our total liability is limited as the Apple EULA sets out. Nothing in these terms limits rights that consumer protection laws give you and that can't be waived.

10. Apple

These terms are between you and us, not Apple. Apple isn't responsible for Vitaspan or its content, has no obligation to provide maintenance or support for it, and isn't responsible for claims about it, including product liability, legal or regulatory compliance, and intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them.

11. Changes and ending

We may update the app and these terms. If a change is significant, the app will ask you to agree again before it applies to you. You can stop using Vitaspan and delete it at any time, and we may stop offering it.

12. Governing law and contact

The governing law and venue set out in the Apple EULA apply to these terms too.
